Consider this scenario. A muslim was tried for being involved with the 9/11 attacks yet he is innocent. The jury agrees with this and he goes off free. Is it patriotic or PI for his employer to fire him or a different employer deny his aplication?

I would say that was completely wrong. His name is cleared... The End.

Also in this country that would be totally illegal, and the employer would be potentially liable for significant damages/fines.

On a last point... allowing prejudice into hiring practices is fundamentally a bad idea. Yes on a moral level. But also just for the hard-nosed reason that you close your mind to someone who might prove to be the best person for the job.

I agree with snaga. If he's innocent then why should he be fired or his application denyed?

Of course firing, or refusing to hire a muslim or any other minority simply because of his ethnic or religious background is both immoral and in many cases illegal; however proving that the employer in question did so strictly out of prejudical motives would be extremly hard to prove. Firing someone because they are bad for morale or a detrement to business is perfectly legal and can be justified by almost anything.

The moral case is almost always easier than the reality of the case.

I don't think firing someone because they are 'bad for morale' would be considered legal in Britain. I'm not sure (not being an expert on employment law) but I'm pretty sure you would need something more specific than that to avoid an unfair dismissal claim. I know the US often favours employers more than employees by comparison to Britain.

In Sweden there would be a moral outrage, the employer would be torn asunder by a mob of PC people lead by Jan Guillou;)
